1. Service Presentation
Biblioscan.ai (hereinafter the "Service" or "Biblioscan") is an online service (SaaS) allowing Users to estimate the value of books from photographs. By uploading a photo of their books, the User obtains an indicative estimate of the resale value of these used books. This service aims to help individuals and professionals quickly identify valuable books in their collection.
2. Acceptance and Scope of the Terms
These Terms of Service (TOS) define the terms of access and use of the Service. They apply to any User of the Biblioscan.ai site. By accessing and using the Service, the User acknowledges having read the TOS and accepts them without reservation. If the User does not accept any provision herein, they must not use the Service. Biblioscan reserves the right to modify the TOS at any time; the version in force is the one accessible online at the time of each use of the Service. Continued use of the Service after modification constitutes acceptance of the updated TOS.
3. Service Access and User Account
The Service is accessible via the Biblioscan.ai website. Some features (such as preserving scan history) require the creation of a User account. The User agrees to provide accurate information when creating their account and to update it if changes occur. Access to the account is protected by a confidential password that the User agrees not to disclose. Any activity carried out from the User's account is presumed to be performed by them. In case of unauthorized use of their account, the User must immediately inform Biblioscan. The Service is in principle accessible 24/7, except for necessary interruptions (maintenance, updates, or force majeure). The Service Editor will make best efforts to ensure the availability of the site, without any obligation of result.
4. Use of Photos – Authorized Content and User Obligations
4.1 Photo Content and Respect for Image Rights
The User is solely responsible for the photos they transmit via the Service. They declare that they are the owner or have obtained the necessary rights and authorizations for the photographs sent. The protection of the right to one's image is a principle recognized in French law. Consequently, the User agrees not to send any photo containing an identifiable individual. Photos transmitted must represent only books or bookshelves, excluding any individuals.
In general, the User agrees that the images sent do not contain any illegal content or content contrary to public order. As such, the photos must not:
- Allow identification of a person, reveal sensitive personal data, or infringe upon the privacy, honor, or reputation of anyone.
- Be of a violent, hateful, pornographic nature or, more generally, contrary to applicable laws and regulations.
- Contain viruses, malware, or any element likely to compromise the computer security of the Service.
By sending a photo, the User guarantees that they hold the necessary rights to it and its content. They ensure, if applicable, that they have obtained the consent of the relevant rights holders. The User also guarantees that the photos transmitted comply with these rules and do not infringe the rights of third parties (right to image, copyright, etc.). Any violation of these conditions may result in the deletion of the offending image and the suspension or termination of the offending User's account, without prejudice to possible legal actions. The User will indemnify Biblioscan for any consequences (damage, complaint, costs) resulting from failure to comply with these commitments.
4.2 License for Biblioscan's Use of Photos
By using the Service and transmitting photos, the User retains full intellectual property of their images. However, they grant the company operating Biblioscan (hereinafter "the Company") a non-exclusive, free, worldwide license for the legal duration of protection of rights, on the photos transmitted. This license allows the Company to reproduce, analyze, modify, and exploit the images for the sole purpose of providing the Service and improving its artificial intelligence algorithms (particularly book detection models through vision and optical character recognition).
Specifically, the User authorizes the Company to use their photos to estimate the value of books (instant analysis via AI) and to integrate these images into training databases to develop and perfect the Service's functionalities. This use includes the possibility of applying automatic processing to the images (for example, to improve title or cover recognition) and extracting data to enrich predictive models. The license granted is in no way intended for external commercial use: Users' photos will not be resold or published as is by the Company without explicit consent, except for their internal use for research and development purposes.
The User understands and accepts that this license is necessary for the very operation of the Service: without these rights, Biblioscan could not technically analyze the transmitted images nor evolve its performance. These authorizations are granted solely for the purpose of providing and improving the Service in accordance with these TOS. No provision of the TOS entails complete assignment of the User's intellectual property rights to their photos. The User remains free to reuse or delete their images at any time.
5. Image and Personal Data Retention
5.1 Photo Retention Policy
By using the Service, the User consents to the photos they send being stored on Biblioscan's servers. The retention period for images is set at 10 years, unless deleted by the User in the meantime. This exceptionally long duration aims to build a historical database enabling continuous training and improvement of the Service's optical character recognition and artificial vision models over the very long term.
However, the Company does not commit to keeping all images for the entirety of this period and reserves the right to delete, at any time, any photo that would no longer be useful for the above purposes (for example, poor quality images, duplicates, irrelevant content, etc.). This early deletion may occur without notice and without compensation, the objective being to optimize storage resources and the relevance of the learning dataset.
5.2 Personal Data and Right to Deletion
Biblioscan attaches great importance to respecting privacy and protecting personal data. Photos transmitted by the User may be considered personal data when they indirectly allow identification of a person (e.g., presence of a named ex-libris on a book, etc.), which is why their processing is carried out in accordance with applicable regulations, notably Regulation (EU) 2016/679 (GDPR) and the French "Data Protection Act." In accordance with GDPR, the User has the right to request erasure of their personal data at any time.
Biblioscan provides the User with a simple means to exercise their right to deletion of their images: via their personal space, the User can delete each of their scans (photos) that they have previously uploaded. The deletion of a scan by the User results in the permanent erasure of the associated photo in Biblioscan's active systems. Trained AI models may retain a trace in the form of aggregated or anonymized data, but this will no longer be linked to the User and will no longer allow reconstruction of the original photo.
If the User wishes to delete their entire account and associated data (including all their photos), they can do so by contacting support via the Contact section of the site or by any other means indicated in the Privacy Policy. The Company commits to deleting or anonymizing the data within a reasonable timeframe from the request, subject to legal retention obligations that may be incumbent upon it.
6. Limitation of Liability and Warranties
6.1 Price Estimates – Information Provided by the Service
The Biblioscan Service provides the User with an estimate of the resale value of books identified in the transmitted photos. These price estimates are given purely for indicative and approximate purposes. Although Biblioscan strives to offer the most accurate evaluations possible, it is noted that many factors can influence the actual value of a book (condition of the copy, market fluctuations, sales context, etc.). Thus, the prices displayed on Biblioscan have no legal or contractual value.
Consequently, the Company cannot under any circumstances be held responsible in case of discrepancy between the price estimated by the Service and the actual price at which a book would be sold or purchased. The User uses the information provided at their own risk.
6.2 Service Availability and Proper Functioning
Biblioscan strives to provide a quality service and maintain it operational at all times. However, the Company offers no absolute guarantee as to the availability, reliability, or error-free nature of the Service. Access to the site may be temporarily interrupted for technical maintenance reasons, updates, or in cases of force majeure.
The Company also does not guarantee that the results provided (identification of titles, price estimation, etc.) will fully satisfy the User's expectations. Biblioscan disclaims all liability for any direct or indirect damages related to the use or inability to use the Service.
6.3 Refund Policy (Paddle)
Payments made on Biblioscan.ai are processed by our partner Paddle.com, official reseller (Merchant of Record).
Right of Withdrawal (14 days)
In accordance with Paddle's terms and applicable European regulations, the User benefits from a right of withdrawal of 14 calendar days following their initial purchase. During this period, they can request a full refund without having to justify reasons, provided they have not begun to benefit from the purchased digital content (access to the paid service or effective use).

- Their explicit decision to cancel the order
- The email address used during the purchase
- The Paddle order number received by email

The refund will be processed by Paddle within a maximum period of 14 days following receipt of a valid request, via the same payment method used during the initial purchase, without additional fees.
Exceptions to the right of withdrawal:
The right of withdrawal does not apply once the User has begun to use or effectively benefit from the digital content.
Requests outside the time limit:
After the legal period of 14 days, Paddle will examine each refund request on a case-by-case basis. Paddle reserves the right to refuse any request deemed abusive, fraudulent, or unjustified.
Responsibility:
Biblioscan.ai disclaims all responsibility for final decisions relating to refunds, which are exclusively the responsibility of Paddle, in accordance with their general terms: https://www.paddle.com/legal/buyers
7. Intellectual Property of the Service
The general structure of the Biblioscan.ai site, as well as all its contents and components (texts, graphics, logos, images, videos, software, databases, etc.), are the exclusive property of the Company or its potential partners and are protected by copyright and/or any other applicable intellectual property right. Biblioscan and its logo are registered trademarks and may not be reproduced without authorization.
The Editor grants the User a personal, non-exclusive, and non- transferable license to use the Service and its content, strictly limited to the needs of using the Service. With the exception of images that the User transmits themselves, the User is prohibited from reproducing, representing, modifying, or extracting all or part of the site's content without prior written authorization.
8. Duration, Suspension, and Termination
This contract is concluded for an indefinite period from the acceptance of the TOS by the User. The TOS remain applicable as long as the User accesses or uses the Service. The User may cease using Biblioscan at any time and delete their account if they have created one (in accordance with article 5.2).
In case of non-compliance with these TOS by the User, the Company may suspend or terminate as of right the access to the Service, temporarily or permanently, without notice or compensation. The Company also reserves the right to permanently discontinue the Service for commercial or technical reasons.
9. SMS Verification
As part of creating your account, we may use your mobile phone number to send you a one-time text message (SMS) to verify your identity and secure your account. This message is sent only once during account confirmation.
If you wish to remove your phone number from our systems or no longer receive SMS messages, you can:
- Send an SMS with the word "STOP" to the number that contacted you
- Contact our support at [email protected] to request the removal of your phone number
Standard message and data rates may apply depending on your mobile carrier.
10. Applicable Law and Dispute Resolution
These TOS are subject to French law. They are written in French and, if applicable, translated into other languages for convenience. In case of divergence of interpretation, the French version shall prevail.
For any dispute relating to the execution or interpretation of these terms, the parties will endeavor to find an amicable solution. Failing that, any dispute will be submitted to the exclusive jurisdiction of the French courts.
